The following terms and conditions apply to all orders via our website, Facebook page and e-mail. The products are aimed exclusively at consumers.

By placing the products on the website, we are submitting a binding offer to conclude a contract for these articles. The contract is concluded when you order the goods by clicking the Facebook button or the email button. Immediately after submitting the order, you will receive another confirmation by email.

With the order you confirm that you have read the Terms of Service.



3. Contract language, contract text storage :

The languages available for the conclusion of the contract are German and English.

We save the contract text and send you the order data and our general terms and conditions by email. For security reasons, the text of the contract is no longer accessible over the Internet.



4. Terms of delivery :

In addition to the stated product prices, shipping costs are added.

All shipments are made exclusively with Deutsche Post as registered mail, parcels only with DHL.

Personal collection is not offered.

If you order the Direct-Cut-Vinyl : they will be sent out from Austria, not from Germany. Different postage costs apply for this.



5. Payment :

The following payment methods are available to you :

The amount to be paid (purchase price + shipping costs) is to be paid exclusively via PayPal.

In the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, legitimize with your access data and confirm the payment instruction to us.

ATTENTION : Please pay only to “Family And Friends”!

If you choose payment for “Goods And Services”, you have to add 2,49% of the hight of the price of your order inclusive postage + 0,35 €. This are the Paypal costs for the payment of “Goods And Services”.



6. Retention of title :

The goods remain our property until full payment.

Goods whose cellophane wrapping / hologram-sticker has been torn open cannot be exchanged!

If you like to order signed copies, you accept that we must open the cellophane wrapping / hologram-sticker  of the CD/MC in your instruction.

Direct-Cut-Vinyl :

For the 7", 10” or 12" vinyl made for you after you orde, there are some special features that you as a customer have to consider.

According to the specific wording of § 312 g Paragraph 2 No. 1 BGB, the statutory right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which is clearly based on the personal needs of the consumer are tailored.

With the decision of principle, the Federal Court of Justice (judgment of March 19, 2003 - VIII ZR 295/01) stipulated the preconditions of the previous provision of Section 312 d (4) No. 1 old version of the German Civil Code. Sie haben die Möglichkeit auch signierte CDs/MCs zu bestellen. In diesem Fall geben Sie der band den Auftrag in Ihren Namen die Cellophanierung/Hologramm-Versiegelung aufzureissen. In diesem Fall ist die Rückgabe der CD/MC ausdrücklich ausgeschlossen. Bestellen Sie keine signierten CDs/MCs wenn Sie damit nicht einverstanden sind.



Besonderheit bei Direkt-Cut Vinyl :

Für die von den für Sie nach der Bestellung gefertigten 7” oder 12” Vinyl gibt es einige Besonderheiten, die Sie als Kunde zu beachten haben.

Nach dem konkreten Wortlaut des § 312 g Abs. 2 Nr. 1 BGB besteht das gesetzliche Widerrufsrecht nicht bei Verträgen zur Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind.

Mit der Grundsatzentscheidung hielt der Bundesgerichtshof (Urteil vom 19.03.2003 – VIII ZR 295/01) die Voraussetzungen der Vorgängervorschrift des § 312 d Abs. 4 Nr. 1 aF BGB fest. 7. Transportschäden :

Werden Waren mit offensichtlichen Transportschäden angeliefert, so reklamieren Sie solche Fehler bitte möglichst sofort beim Zusteller und nehmen Sie bitte unverzüglich Kontakt zu uns auf. Die Versäumung einer Reklamation oder Kontaktaufnahme hat für Ihre gesetzlichen Ansprüche und deren Durchsetzung, insbesondere Ihre Gewährleistungsrechte, keinerlei Konsequenzen. Sie helfen uns aber, unsere eigenen Ansprüche gegenüber dem Frachtführer bzw. der Transportversicherung geltend machen zu können.



8. Gewährleistung und Garantien :

Es gilt das gesetzliche Mängelhaftungsrecht.



9. Haftung :

Für Ansprüche aufgrund von Schäden, die durch uns, unsere gesetzlichen Vertreter oder Erfüllungsgehilfen verursacht wurden, haften wir stets unbeschränkt

   bei Verletzung des Lebens, des Körpers oder der Gesundheit,

   bei vorsätzlicher oder grob fahrlässiger Pflichtverletzung,

   soweit der Anwendungsbereich des Produkthaftungsgesetzes eröffnet ist.

Bei Verletzung wesentlicher Vertragspflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf, (Kardinalpflichten) durch leichte Fahrlässigkeit von uns, unseren gesetzlichen Vertretern oder Erfüllungsgehilfen ist die Haftung der Höhe nach auf den bei Vertragsschluss vorhersehbaren Schaden begrenzt, mit dessen Entstehung typischerweise gerechnet werden muss.
