With the decision of principle, the Federal Court of Justice (judgment of March 19, 2003 - VIII ZR 295/01) stipulated the preconditions of the previous provision of Section 312 d (4)

Für die von den für Sie nach der Bestellung gefertigten 7” oder 12” LP  Vinyl gibt es einige Besonderheiten, die Sie als Kunde zu beachten haben.

Nach dem konkreten Wortlaut des § 312 g Abs. 2 Nr. 1 BGB besteht das gesetzliche Widerrufsrecht nicht bei Verträgen zur Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind.

Mit der Grundsatzentscheidung hielt der Bundesgerichtshof (Urteil vom 19.03.2003 – VIII ZR 295/01) die Voraussetzungen der Vorgängervorschrift des § 312 d Abs. 4 Nr. 1 aF BGB fest. Der BGH wörtlich: Das Widerrufsrecht des Verbrauchers ist deshalb nur dann wegen Anfertigung der Ware „nach Kundenspezifikation“ ausgeschlossen, wenn der Unternehmer durch die Rücknahme auf Bestellung angefertigter Ware erhebliche wirtschaftliche Nachteile erleidet, die spezifisch damit zusammenhängen und dadurch entstehen, dass die Ware erst auf Bestellung des Kunden nach dessen besonderen Wünschen angefertigt wurde.

Deshalb ist die Rücknahme der für Sie produzierten Direct-Cut Vinyls ausdrücklich ausgeschlossen.
